2. Scope
This privacy policy applies to the processing of personal data in connection with the art fair, our website and related services. Swiss data protection law applies; to the extent additionally applicable, we also comply with foreign data protection law.

3. Data We Process
We process data you provide to us (e.g. name, contact details, company, role, payment data, application documents), technical usage data generated when you use our website (e.g. IP address, browser, device, access times, pages visited, cookie data) as well as data from public sources or partners, to the extent permitted by law.

4. Purposes of Processing
We process personal data to organise and carry out the art fair, manage exhibitors and visitors, handle ticketing, communications, respond to enquiries, send newsletters and marketing, operate, secure and improve the website, comply with legal obligations, and enforce claims and prevent misuse. Where required, we rely on contract, consent, legal obligations or overriding interests. We send newsletters and other electronic marketing only with consent or within legally permitted exceptions; you may unsubscribe at any time. In our communications, we may publish names of participating galleries and artists as well as photos and videos from events. For close-up photographs used for promotional purposes, we obtain consent where required.

5. Automated Individual Decisions
We do not make automated individual decisions that produce legal effects or similarly significantly affect you.

6. Cookies and Tracking
We use cookies and similar technologies. Non-essential cookies, in particular for analytics and marketing, are only set with your prior consent. You may change your preferences at any time via the cookie settings. Newsletters may contain tracking pixels and tracking links to measure usage and reach.

7. Recipients
We may disclose personal data to processors, in particular for hosting, IT, email delivery, payment processing, CRM and analytics. Other recipients include authorities, to the extent required by law or for the enforcement of legal claims. Disclosure to exhibitors, co-organisers or other event partners is made only to the extent necessary for the event, with your consent or on a legal basis. We do not sell personal data.

8. Cross-Border Disclosures
We may disclose personal data abroad. If the disclosure is to a country without an adequate level of data protection, we safeguard the data through standard data protection clauses, the adjustments required for Switzerland, and supplementary technical and organisational measures. Where legally permissible, we may exceptionally rely on a statutory exception.

9. Retention
We generally retain contractual data for up to 10 years. Newsletter data is stored until revocation of consent; thereafter we maintain a suppression list. Enquiries, correspondence and web server logs are generally retained for up to 12 months. Consent and unsubscribe records are retained for up to 5 years or as long as legally required. After expiry, we delete or anonymise the data.

10. Data Security
We take appropriate technical and organisational measures to protect your personal data, including access controls, encryption, security updates, backups, training and careful selection of our service providers.

11. Your Rights
Under applicable law, you have in particular the right to access, rectification, erasure, prohibition or restriction of processing, data portability, and objection to direct marketing. You may revoke any consent at any time. You may also lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC); where applicable, also with a foreign supervisory authority. Please direct requests to data@liste.ch. We generally respond within 30 days. We reserve the right to verify your identity.

12. Amendments
We may amend this privacy policy. The version published on our website at any given time shall apply.
